The Traffic Commissioner’s Office has warned waste sector and other employers of the “risks” their drivers could face if caught using a mobile phone whilst driving.
In a statement earlier this month, the TCO warned that if caught, “professional drivers” could be suspended from driving commercial vehicles, “in addition to the fine points and penalties they’ll receive.”
This will consist of six penalty points, as well as incurring fines of up to a £2,500.
HGV and PSV drivers caught “twice” or accruing 12 points on their licence, could be summoned to a magistrates court.
Conduct hearings
The statement notes: “Traffic commissioners who are told about mobile phones offending will call drivers in to conduct hearings.
“If a driver’s caught in a commercial vehicle, the minimum suspension period is four weeks. That will affect their livelihood and is likely to impact on your business too.”
A spokesman from the TCO, told letsrecycle.com that professional drivers in all business sectors, including waste, should be aware of the “risks” involved.
Larger vehicles
He said: “Larger vehicles present a great danger to road safety. The Traffic Commissioners office has found that offending is still at a high rate across the board and is still a significant area.”
The Department has issued a safety leaflet for business owners to share with their drivers and line managers, which outlines the “dangers” of using a hand held device as well as their responsibilities whilst on the road.
The report said: “Professional drivers have a responsibility to maintain a high standard of driving to ensure the safety of other, more vulnerable road users.”
Penalties for using a mobile phone while driving have recently been raised with the fixed penalty points issued under a fixed penalty notice for the offence from 3 to 6 for all drivers. The fixed penalty notice fine has been increased from £100 to £200 for all motor vehicles with higher amounts for HGV/PSV drivers.
Hands free
The TCI also commented that Hands free mobile phone use is legal but “it is distracting and can therefore be dangerous. Depending upon the individual circumstances, drivers could be prosecuted with ‘failing to have proper control of their vehicle’.”
