PRN consultant jailed for tax fraud

A trader in PRNs – packaging waste recovery notes – has been jailed for 21 months for tax fraud.

John Gerald Hamill, of McCardel Way, Kilmarnock, Scotland, who was described in court as a “recycling consultant”, was investigated by HMRC which said that he had “stolen more than £300,000 in tax”. He pleaded guilty at a hearing at Kilmarnock Sheriff Court on 11 May 2018.

His work involved the sourcing and supply of PRNs.

HMRC noted that Mr Hamill, 53, of Stewarton, “traded as a sole proprietor for GH Consulting from his home in McCardel Way.”

Between April 2006 and 2014 Hamill made profits of more than £1.3 million and failed to pay any Income Tax, said the government body.

The court heard that until his arrest in July 2014, Hamill, also known as Gerry, stole a total of £309,941.95. Mr Hamill pleaded guilty to Income Tax fraud at Kilmarnock Sheriff Court on 3 April 2018 and was sentenced to 21 months in jail at the same court on Friday. HMRC noted that he has since paid back “£56,000 of the fraud”.

Joe Hendry, assistant director, Fraud Investigation Service, HMRC, said: “Hamill failed to register for Self Assessment and used the stolen tax to fund his lifestyle. This was money that should have been funding vital public services.

The offence was contrary to section 106A of the Taxes Management Act 1970.
